The power of attorney goes to the licensed attorney.

Intake of the disclosure

We collect your invention disclosure and documents and forward them. We do not assess patentability or draft claims.

Assessment and route

The licensed Liechtenstein patent attorney assesses patentability and chooses the route with you. Advice and representation in patent matters are the attorney's under the Patent Attorneys Act (PAG), Art. 8(1).

Engagement letter and power of attorney

You sign; the attorney accepts. A patent attorney is not obliged to take on a mandate (PAG Art. 12(1)).

The application

The patent attorney drafts the request, description, claims, drawings and abstract. You supply the invention; we coordinate the papers.

Filing

The patent attorney files with the Swiss IPI, the European Patent Office or under the PCT.

Objections and after grant

The patent attorney answers office objections and handles renewal fees, transfers and licences.

Your own licence check

You check the attorney's name in the public FMA register before you sign (PAG Art. 48c).

One territory, three routes

Liechtenstein and Switzerland form one protection territory for patents, administered by the Swiss IPI in Bern. The Office of Economic Affairs handles trademarks, not patents: see registering a trademark with the Liechtenstein Office of Economic Affairs.

How the process works

No official time is fixed for examination or grant, so we quote none; only the statutory periods below.

Steps of a patent filing

  1. Disclosure and documents

Who acts: Client supplies, VCS collects

  2. Engagement letter and power of attorney

Who acts: Client signs, patent attorney accepts

  3. Application drafted

    Who acts: Patent attorney

  4. Filing

With the IPI, the EPO or under the PCT; extension abroad within 12 months

    Who acts: Patent attorney

  5. Examination and grant

PCT national phase within 30 months of the priority date

    Who acts: IPI or EPO

  6. After grant

Renewals, transfers, licences; term ends 20 years after filing at the latest

    Who acts: Patent attorney

  7. Register check

    Who acts: Client, before signing

Seven steps, statutory periods only.
  1. Disclosure and documents

You supply the disclosure, drawings, description and any earlier filing for the priority claim. We collect them and forward them to the patent attorney.

  2. Engagement letter

You sign the engagement letter and the power of attorney with the identity and company details of the applicant.

  3. Application prepared

The patent attorney drafts the request, description, claims, drawings and abstract, with a priority claim where a first filing exists.

  4. Filing

The patent attorney files on the chosen route. After a Swiss filing, extension abroad is possible within 12 months.

  5. Examination and grant

The IPI or the EPO examines; the patent attorney answers objections. On the PCT route, the national phase starts within 30 months of the priority date.

  6. After grant

The patent attorney pays renewal fees and handles transfers and licences. Court work goes to a lawyer; see also how a .li domain dispute is brought before the WIPO panel.

  7. Register check

Before you sign, you look up the attorney in the public FMA register, kept by the authority that supervises patent attorneys.

What changes on 1 January 2027

The partially revised Swiss Patents Act comes into force on 1 January 2027 and applies in Liechtenstein through the treaty. Every application gets a search report, full examination becomes optional, and technical documents may be filed in English.

Problems we solve

"I want a Liechtenstein patent"

There is none apart from the Swiss one. A patent has the same effect in both states and is granted or lapses only for the whole territory.

"I do not know who files"

The licensed Liechtenstein patent attorney files; we coordinate. Exercising a reserved patent-attorney activity by way of business without authorisation is an offence under PAG Art. 47.

"Do I need a local attorney?"

Before the Swiss office, persons domiciled or seated in Liechtenstein act as representatives only if Liechtenstein law entitles them (treaty Art. 8). The IPI itself recommends taking advice before applying.

"Patent attorney or lawyer?"

Two licences: PAG for patent attorneys, the Lawyers Act (RAG) for lawyers. Professional court representation is the lawyers' (RAG Art. 8(1)(b)); Art. 8(3) leaves patent attorneys' powers untouched.

"The 2027 rules and my timetable"

The revision applies from 1 January 2027. The 12-month and 30-month periods stay the attorney's to plan around.

Need the licensed attorney named before you decide?

The patent attorney is named in your engagement letter, and you can check the name in the FMA register.

Why work with VCS

Elias Gruber leads our corporate files and speaks German, English and French. From our practice: Elias prepares the intake file, collects the applicant's identity and company papers and the signed power of attorney, and passes them to the licensed patent attorney. No one at VCS is a patent attorney or represents anyone before a patent office.

Frequently asked questions about patent filings in Liechtenstein

Why can I not get a "Liechtenstein patent" on its own?

Liechtenstein and Switzerland form one protection territory for invention patents under their 1978 patent treaty, in force since 1 April 1980 (Art. 1). A patent has the same effect in both states and can be granted, transferred, declared void or lapse only for the territory as a whole (Art. 4(1)). So a Liechtenstein patent is always a Swiss one too.

If I already hold a Swiss patent, is my invention protected in Liechtenstein?

Yes. The Swiss Federal Institute of Intellectual Property states that a Swiss patent filed with it is valid in Switzerland and Liechtenstein. Under the treaty, the patent has the same effect in both states, whichever route led to it. The patent ends 20 years after the filing date at the latest.

Does a European patent validated for Switzerland cover Liechtenstein too?

A European patent can be obtained for the two states only by joint designation under the European Patent Convention (treaty Art. 2). Designating one therefore means designating both. Whether a unitary patent covers Liechtenstein is not stated on this page; the licensed patent attorney answers that question for your file.

Does VCS file my patent?

No. The licensed Liechtenstein patent attorney assesses patentability, drafts the application and files it; advice and representation in patent matters are the attorney's under PAG Art. 8(1). VCS collects your documents, forwards them and coordinates the file. The attorney is named in your engagement letter.

Do I have to use a Liechtenstein patent attorney, or can I use a Swiss, German or US attorney?

Before the Swiss office, persons domiciled or seated in Liechtenstein can be appointed representatives only if Liechtenstein law entitles them to professional patent representation (treaty Art. 8). EEA nationals lawfully established and entitled to practise as patent attorneys in the EEA may serve temporarily and occasionally after written notice to the FMA (PAG Art. 40–41). Other cases: no rule stated.

Is a patent attorney the same as a lawyer?

No. A patent attorney holds an FMA licence under the Patent Attorneys Act, which covers advice and representation in intellectual property matters. Professional party representation in court belongs to lawyers under the Lawyers Act, Art. 8(1)(b). Art. 8(3) of that act leaves the statutory powers of patent attorneys untouched.

How do I check that a patent attorney is licensed?

The FMA keeps a public register of every person subject to the Patent Attorneys Act and updates it regularly (PAG Art. 48c). Look up the name in your engagement letter there before you sign. A licensed attorney keeps an office in Liechtenstein and carries professional indemnity cover of at least two million francs (Art. 10, 17(3)).

Where is the patent office of Liechtenstein?

There is none for patents. Under treaty Art. 7(1), the Swiss Federal Institute of Intellectual Property in Bern carries out the administrative tasks for the whole territory. The European Patent Office handles European applications, and the Office of Economic Affairs is the national contact for intellectual property law and handles trademarks.

Which routes exist: Swiss, European or PCT?

Three routes lead to two types of patent: the national Swiss route, with extension abroad within 12 months; the European route, by joint designation of both states; and the PCT route, with the national phase within 30 months of the priority date. The patent attorney chooses the route with you. No official grant time is fixed.

What changes with the Swiss patent law of 1 January 2027?

The revised law, in force from 1 January 2027, brings a fee-based search report for every application, makes full examination optional and allows technical documents in English. The official application fee stays CHF 200 but covers 15 claims instead of ten. Renewal fees fall due from the third year after filing.

How long does a patent last?

A patent expires 20 years after the filing date at the latest, in all cases. Under the 2027 rules, renewal fees to the Swiss office fall due from the third year after filing instead of the fourth, and rise by a total of 8 % over the maximum term, for fees due from 1 March 2027.

What happens if someone infringes my patent in Liechtenstein?

Liechtenstein courts decide patent civil actions as the single instance and try infringement offences in first and second instance (treaty Art. 10). Rulings can be challenged at the Swiss Federal Supreme Court (Art. 11). Professional representation of parties in court is the lawyers' under RAG Art. 8(1)(b), subject to Art. 8(3), so court work goes to our IP disputes service.

Can my Liechtenstein company hold the patent?

This page makes no statement on who should hold a patent, and none on tax. Under treaty Art. 7(2), the Swiss office is receiving office for PCT applications of persons with seat or domicile in Liechtenstein. On the company side, see the legal form that carries a group's shareholdings and the detailed ready-made companies page.
